COLUSA LOCAL AGENCY FORMATION COMMISSION NOTICE OF PUBLIC HEARING Notice is hereby given by the Local Agency Formation Commission that public hearings will be held on March 1st, 2012 at 3:00 p.m. in the Colusa County Board of Supervisor’s Chambers 546 Jay Street, Colusa, California, regarding the following items: 1. LAFCO File No. 2011-04, a request by the Colusa County Water District to detach 40 acres more or less of territory known as the Almond Ranch Estates Subdivision and the Michael T. Phelan Family LP property located on Wildwood Road in Arbuckle (Assessors Map Bk 21 pg. 33). There is no longer a need for Colusa County Water District to provide irrigation water to the territory since the district serves non-potable water only. 2. Request for Reconsideration of LAFCo’s December 8, 2011 decision to adopt the Sphere of Influence for the Sacramento River Fire Protection District. The reasons for the reconsideration is LAFCO did not fully explore the implications of the change to the sphere with respect to the properties in the north east corner of Colusa County, north of the Moulton Weir. The Commission will consider oral and written testimony by any interested person or affected agency as well as the report of the Executive Officer. At the hearings, the Commission may approve or disapprove a proposal with or without amendment, wholly, partially, or conditionally, may include or exclude territory in an annexation or may continue its consideration with or without amendment, as a whole, in part, or upon such conditions as the Commission may determine. This notice complies with Section 15182 of the CEQA Guidelines. (For reconsideration requests the consideration may be continued from time to time but not to exceed 35 days from the date specified in this notice). The Commission may waive protest and election proceedings if no written protests or objections are raised at this hearing by persons either owning land within the subject territory or, in the case, the territory is inhabited, by anyone registered to vote who is currently residing within the consolidation and formation territory. Persons may attend and be heard at the time and place of the hearing. If you challenge the action of the Commission on any of the above stated items in court, it may be limited to only those issues raised at the public hearing described in this notice, or in written correspondence delivered to the Colusa Local Agency Formation Commission at, or prior to, the public hearing.
